Depuis Droit, mythe et raison (1980) écrit avec Jacques Lenoble jusqu’aux récents À quoi sert le droit? Usages, fonctions et finalités (2016) ou Le droit, objet de passions (2018), François Ost ne cesse de questionner les rapports de nos sociétés au droit et la place de celui-ci dans nos sociétés contemporaines. Avec Le droit malgré tout, il s’agit de rendre hommage à l’œuvre et à la carrière d’une figure centrale de la théorie du droit contemporaine et aussi au fondateur, avec (...) le regretté Michel van de Kerchove, de ce que l’on appelle parfois « l’école de Saint-Louis ». Abordant les deux pôles de la dialectique à laquelle François Ost est si attaché - la critique et la reconstruction -, l’ouvrage propose un regard interdisciplinaire sur le droit, à travers les principaux thèmes qui ont nourri la pensée de l’auteur. In the wake of the 2008 global financial crisis, an important conceptual battleground for democratic theorists ought to be, it would seem, the capitalist firm. We are now painfully aware that the typical model of government in so-called investor-owned companies remains profoundly oligarchic, hierarchical, and unequal. Renewing with the literature of the 1970s and 1980s on workplace democracy, a few political theorists have started to advocate democratic reforms of the workplace by relying on an analogy between firm and state. To (...) the extent that a firm is an organization comparable to the state, it too ought to be ruled along democratic lines. Our paper tests the robustness of the analogy between firm and state by considering six major objections to it: the objection from a difference in ends, the objection from shareholders’ property rights, the objection from worker’s consent, the objection from workers’ exit opportunities, the objection from workers’ expertise, and the objection from the fragility of firms. We find all of these objections wanting. While the paper does not ambition to settle the issue of workplace democracy at once, our goal is to pave the way for a more in-depth study of the ways in which firms and states can be compared and the possible implications this may have for our understanding of the nature of managerial authority and the governance of firms. Prepared for an ANU Humanities Research Centre Symposium in early August 2003, these notes may be considered as a comment on Brian Massumi’s proposition that ‘a political ecology would be a social technology of belonging, assuming coexistence and co-becoming as the habitat of practices’.

This book promotes the research of present-day women working in ancient and medieval philosophy, with more than 60 women having contributed in some way to the volume in a fruitful collaboration. It contains 22 papers organized into ten distinct parts spanning the sixth century BCE to the fifteenth century CE. Each part has the same structure: it features, first, a paper which sets up the discussion, and then, one or two responses that open new perspectives and engage in further reflections. (...) Our authors’ contributions address pivotal moments and players in the history of philosophy: women philosophers in antiquity, Cleobulina of Rhodes, Plato, Lucretius, Bardaisan of Edessa, Alexander of Aphrodisias, Plotinus, Porphyry, Peter Abelard, Robert Kilwardby, William Ockham, John Buridan, and Isotta Nogarola. The result is a thought-provoking collection of papers that will be of interest to historians of philosophy from all horizons. Like language, music is a complex, rule-governed activity that seems specific to humans, and associated with a specific brain architecture. Yet unlike most other high-level functions of the human brain - and unlike language - music is a skill at which only a minority of people become proficient. The study of music as a major brain function has for (...) some time been relatively neglected. Just recently, however, we have witnessed an explosion in research activities on music perception and performance and their correlates in the human brain. This volume brings together an outstanding collection of international authorities - from the fields of music, neuroscience, psychology, and neurology - to describe the amazing advances being made in understanding the complex relationship between music and the brain. Throughout much of his writing, Whitehead outlines a critique of what he termed the `bifurcation of nature'. This position divides the world into objective causal nature, on the one hand, with the perceptions of subjects on the other. On such a view, truth lies in a reality external to such subjects and it is the task of science to deliver clear and immediate access to this realm. Further, judgments about this external reality are the province of human subjects and it (...) is the task of philosophy to ascertain the validity or otherwise of these. This article outlines Whitehead's attempts to develop a conception of nature which avoids this premise; it also explains how he offers a way for contemporary theories to construct or engineer abstractions which go beyond notions of social construction or deconstruction. This article argues that not only does Whitehead offer a coherent alternative to such approaches but that the manner in which his major text is written reflects his commitment to the inherently constructed and constructing character of all existence. It is sometimes said that simulation can serve as epistemic substitute for experimentation. Such a claim might be suggested by the fast-spreading use of computer simulation to investigate phenomena not accessible to experimentation. But what does that mean? The paper starts with a clarification of the terms of the issue and then focuses on two powerful arguments for the view that simulation and experimentation are ‘epistemically on a par’. One is based on the claim that, in experimentation, no less than (...) in simulation, it is not the system under study that is manipulated but a system that ‘stands-in’ for it. The other one highlights the pervasive use of models in experimentation. It will be argued that these arguments, as compelling as they might seem, are each based on a mistaken interpretation of experimentation and that, far from simulation and experimentation being epistemically on a par, they do not have the same epistemic function, do not produce the same kind of epistemic results. The question of universalism and relativism is often taken to be a matter of critical reflexivity. This article attempts to present the question instead as a matter of practical, political, and always-situated concern. The attempt starts from the consideration of modern experimental sciences. These sciences usually serve as the stronghold for universalist claims and as such are a target of relativism. It is argued that the specificity of these sciences is not a method but a concern. To be able to (...) claim that they have not unilaterally imposed their definitions on the phenomena they study is the leading concern of experimenters and should be understood in terms of the following achievement: the creation of a very particular “rapport” that authorizes claiming that what is operationally defined “lends itself” to this correlation. Linking knowledge production with a creation of rapports entails a pluralization of sciences along with the pluralization of modes of concern associated with the rapport. However, resisting unilaterally imposed definitions is not enough, since with the coming “knowledge economy” the questions that this article raises will soon be part of a romantic past. Thus it concludes with a speculative touch, which may be a requiem, relating the creation of rapports with an ecology of practices akin to William James's always-under-construction pluriverse. This paper suggests that one single thread characterizes the developments of French phenomenology that occurred after 1990 in the wake of Merleau-Ponty's and Levinas's major contributions. Janicaud in 1991 had already identified one global trend in French phenomenology and believed it was possible to unite the thoughts of Levinas, Henry, Marion and Chrétien under the common banner of “theological phenomenology.” However, his analysis seems to fail to account for deeper-seated affinities that exist between French phenomenologists such as Marion, Lacoste, Chrétien, (...) Richir, Depraz, Romano – and Benoist for part of his work. This is the reason why, although the present paper does agree with Janicaud's idea that the French authors who define themselves as phenomenologists share some common ground, it defines this common trend quite differently, i.e., as a form of epistemological realism that ultimately manifests itself as a radical empiricism. Consequently, the present study will state and defend three hypotheses: contemporary French phenomenology professes a form of realism of experience, which is the true rallying point of otherwise differing elaborations; this type of epistemological empiricism, by virtue of its radicality, implies a problem that threatens to drive phenomenology towards its own dissolution, because as it precipitates in fine the dilution of philosophical discourse into a multitude of other discourses; this variant of empiricism shows that, within its strictly defined viewpoint, there is scarcely any difference between French phenomenology and a certain part of French analytical philosophy. All three hypotheses lead to the same conclusion: the determination of the defining aspect of contemporary French phenomenology entails, beyond the apparent, misleading, and futile quarrel of paradigms, to bring to light a common space for contemporary French philosophy, which, from both perspectives, can be conveyed by the single term “to show.” It is, in fact, the elevation of “to show” to the detriment of “to demonstrate” that seems to ensnare thinkers within an impasse. The Īśvarapratyabhijñā treatise—an important philosophical text composed in Kashmir in the 10th century CE by the Śaiva nondualist Utpaladeva—remains partly unavailable to date: a crucial component of this work, namely the detailed commentary (Vivṛti or Ṭīkā) in which Utpaladeva explained his own verses, is considered as almost entirely lost, since only a small part of it has been preserved in a single, very incomplete manuscript remarkably edited and translated by Raffaele Torella. However, our knowledge of the Vivṛti is quickly expanding: (...) many additional fragments have recently come to light. The article gives an overview of these new findings while highlighting the most interesting of them, i.e. the discovery of the lengthiest Vivṛti fragment known to date in the margins of a manuscript containing Abhinavagupta’s Vivṛtivimarśinī. Urban agriculture (UA) is spreading within the Global North, largely for food production, ranging from household individual gardens to community gardens that boost neighborhood regeneration. Additionally, UA is also being integrated into buildings, such as urban rooftop farming (URF). Some URF experiences succeed in North America both as private and community initiatives. To date, little attention has been paid to how stakeholders perceive UA and URF in the Mediterranean or to the role of food production in these initiatives. This study (...) examines the promotion and inclusion of new forms of UA through the practice of URF and contributes to the nascent literature on the stakeholder and public perceptions of UA. It seeks to understand how those perceptions shape the development of new urban agriculture practices and projects. Barcelona (Spain) was used as a Mediterranean case study where UA and URF projects are growing in popularity. Through semi-structured interviews with 25 core stakeholders, we show that UA is largely perceived as a social activity rather than a food production initiative, because the planning of urban gardens in Barcelona was traditionally done to achieve leisure and other social goals. However, several stakeholders highlighted the potential to increase urban fertility through URF by occupying currently unused spaces. As a result, the positive valuation of URF depends on the conceptualization of UA as a social or food production activity. In turn, such conceptualization shapes barriers and opportunities for the development of URF. While most UA-related stakeholders (e.g., food co-ops, NGOs) preferred soil-based UA, newer stakeholders (e.g., architects) highlighted the economic, social and environmental opportunities of local and efficient food production through innovative URF. Experimental modeling is the construction of theoretical models hand in hand with experimental activity. As explained in Section 1, experimental modeling starts with claims about phenomena that use abstract concepts, concepts whose conditions of realization are not yet specified; and it ends with a concrete model of the phenomenon, a model that can be tested against data. This paper argues that this process from abstract concepts to concrete models involves judgments of relevance, which are irreducibly normative. In Section 2, we (...) show, on the basis of several case studies, how these judgments contribute to the determination of the conditions of realization of the abstract concepts and, at the same time, of the quantities that characterize the phenomenon under study. Then, in Section 3, we compare this view on modeling with other approaches that also have acknowledged the role of relevance judgments in science. To conclude, in Section 4, we discuss the possibility of a plurality of relevance judgments and introduce a distinction between locally and generally relevant factors. (shrink)

Despite significant promotion of diversity in companies, as well as legislation for equal opportunities for women and men, it must be noted that women still remain largely in the minority in decision-making positions. This observation reflects the phenomenon of the glass ceiling that constitutes vertical discrimination within companies against women. Although the glass ceiling has generated research interest, some authors have pointed out that theoretical models have made little attempt to develop an understanding of this phenomenon and its implications. Therefore, (...) our study aims to fill this gap and to better understand the phenomenon of the glass ceiling by considering both its antecedents and its possible consequences. More precisely, we extend the model developed by Elacqua et al., proposing a more comprehensive model including organizational gender culture as a third factor in the emergence of the glass ceiling through the perception of differential treatment. We also investigated the glass ceiling’s consequences for organizational attitudes and well-being at work by considering work-to-family conflict as a possible mediator. We surveyed 320 women in managerial positions in a Belgian organization. Our study highlights the importance of all three factors in the emergence of the perception of differential treatment and, ultimately, the perception that a glass ceiling exists. Moreover, our results show that WFC fully mediates the effects of the glass ceiling on job strain and job engagement, and partially mediates the effects of the glass ceiling on job satisfaction and intention to quit. It is a well-known fact that the Śaiva nondualistic philosopher Utpaladeva (fl. c. 925–975) adopted the Sāṃkhya principle according to which the effect must exist in some way before the operation of its cause (satkāryavāda). Johannes Bronkhorst has highlighted the paradox inherent in this appropriation: Utpaladeva is a staunch supporter of the satkāryavāda, but whereas Sāṃkhya authors consider it as a means of proving the existence of an unconscious matter, the Śaiva exploits it so as to establish his monistic idealism, (...) in perfect contradiction with the Sāṃkhya dualism of matter and consciousness. How does Utpaladeva achieve this complete reversal of meaning of the satkāryavāda? The present article argues that the elliptical verses of the Īśvarapratyabhijñākārikā dealing with this issue have been partly misunderstood so far due to the loss of Utpaladeva’s own detailed commentary (Vivr̥ti) on this passage: Abhinavagupta’s two commentaries, however terse in this respect, clearly show that a crucial part of Utpaladeva’s reasoning remains implicit in the verses. The article therefore attempts to reconstruct the gist of Utpaladeva’s strategy by having recourse to various other Śaiva sources, including Somānanda’s Śivadr̥ṣṭi and Utpaladeva’s own commentary thereon. This examination shows that Utpaladeva’s appropriation of the satkāryavāda rests on a profound transformation of the Sāṃkhya notions of manifestation (abhivyakti) and potentiality (śakti), and that his criticism of the Sāṃkhya understanding of causality might target the Śaiva dualists as well as Sāṃkhya authors. BackgroundInnovations in technology have contributed to rapid changes in the way that modern biomedical research is carried out. Researchers are increasingly required to endorse adaptive and flexible approaches to accommodate these innovations and comply with ethical, legal and regulatory requirements. This paper explores how Dynamic Consent may provide solutions to address challenges encountered when researchers invite individuals to participate in research and follow them up over time in a continuously changing environment.MethodsAn interdisciplinary workshop jointly organised by the University of Oxford (...) and the COST Action CHIP ME gathered clinicians, researchers, ethicists, lawyers, research participants and patient representatives to discuss experiences of using Dynamic Consent, and how such use may facilitate the conduct of specific research tasks. The data collected during the workshop were analysed using a content analysis approach.ResultsDynamic Consent can provide practical, sustainable and future-proof solutions to challenges related to participant recruitment, the attainment of informed consent, participant retention and consent management, and may bring economic efficiencies.ConclusionsDynamic Consent offers opportunities for ongoing communication between researchers and research participants that can positively impact research. Dynamic Consent supports inter-sector, cross-border approaches and large scale data-sharing. Whilst it is relatively easy to set up and maintain, its implementation will require that researchers re-consider their relationship with research participants and adopt new procedures. (shrink)

In one way or another medicine has today become ‘modern’ in the same way as the whole set of knowledges and practices that call themselves rational. This is obvious, but I would like to interrogate this obviousness. Not to debunk it so as to show that beyond these appearances nothing has changed, but in order (...) to focus in a slightly clearer way on ‘what’ has changed. To be even more precise, I would like to focus on ‘what’ has changed for the doctor, the one who practises medicine. (shrink)

Participation of the Public in Science: Towards a New Kind of Scientific Practice Participation of the public in science has been the object of an increasing number of social and political philosophical studies, but there is still hardly any epistemological study of the topic. While it has been objected that involvement of the public is a threat to the integrity of science, the apparent indifference of philosophers of science seems to testify to its lack of relevance to conceptions of scientific (...) activity. I argue both that it is not a threat to science and that it is relevant to philosophy of science by showing that it constitutes a new kind of epistemic practice. Two main objections to the idea that the involvement of non-scientists, with their situated perspective and contextual values, can form an epistemic practice will be addressed: the first bears on the epistemic potentialities of the cooperation between scientist and non-scientists; the second on the possibility that this cooperation takes the form of a practice. Social and environmental ratings provided by social rating agencies are multidimensional. The first goal of our paper is to identify a small number of independent and relevant socially responsible (SR) dimensions reflecting a firms’ coherent posture toward social issues. We put forward that these dimensions are not exactly the same as the ESG ones (Environment, Social, and Governance). Using the six sub-ratings provided by the Vigeo rating agency, we perform a principal component analysis and we highlight three main independent SR (...) dimensions related to (1) business stakeholders (employees, customers, and suppliers), (2) societal stakeholders (environment and society), and (3) financial stakeholders (stockholders and debt holders). The second objective of our paper is to explore the link between stock returns and these three SR dimensions. Our most notable finding is that for each SR dimension, investors ask for an additional risk premium when they accept to hold non-socially responsible stocks. The cost of equity is thus lower for SR firms. The average premium over the period 2003–2010 is larger for the components “business stakeholders” and “financial stakeholders” than for the component “societal stakeholders.” The premium for this last component has only existed since the end of 2008. Since that time, environment and community involvement have become important risk factors strongly considered by investors. For the three dimensions, investors notably penalize large non-social firms and reward small social firms. (shrink)

The aim of this paper is to put into context the historical, foundational and philosophical significance of category theory. We use our historical investigation to inform the various category-theoretic foundational debates and to point to some common elements found among those who advocate adopting a foundational stance. We then use these elements to argue for the philosophical position that category theory provides a framework for an algebraic in re interpretation of mathematical structuralism. In each context, what we aim to show (...) is that, whatever the significance of category theory, it need not rely upon any set-theoretic underpinning. (shrink)

It may be that denouncing the ideals of objectivity or neutrality associated with the sciences leads us into a trap: that of accepting, in order to criticize it, that there would be a common identity for the many ways to produce science. Learning to laugh, we choose to laugh with and laugh at. But we accept the risk of being interested, that is, of giving up the position of a judge.

This article explains how the issue of inclusion is central to Habermas’s theory of democracy and how it is deeply rooted in his conception of a political public sphere. After recalling Habermas’s views on the public sphere, I present and discuss various objections raised by other critical theorists: Oskar Negt and Alexander Kluge, Nancy Fraser, Axel Honneth and Iris Marion Young. These criticisms insist on the paradoxically excluding effects of a conception of democracy that promotes civic participation in the public (...) debate. Negt, Kluge and Fraser develop a Marxist line of analysis that question who can participate in the public sphere. Honneth and Young criticize in various ways the excluding effect of argumentation: are unargumentative speeches excluded from the public debate? I show how Habermas’s model can provide some responses to these various objections by drawing inspiration from his treatment of the gap between religious and post-metaphysical world views. (shrink)

Children who grow up exposed to more than one language face a range of challenges and developmental environments which differ from those of monolinguals. Recently, studies have suggested that this may lead to differences in the development of pragmatic skills and sensitivity to socio-pragmatic cues. We investigate whether bilingually exposed children are able to make further use of these cues in an ostensive teaching setting for word learning in a sample of 110 children aged 4 to 6 years old and (...) find evidence that bilingual children do perform significantly better in ostensive teaching settings when asked to use pragmatic cues to derive the meaning of a novel word. We discuss implications for theories of pragmatics and bilingual development. (shrink)

Adorno entretient un rapport ambivalent à la théorie morale de Kant en la considérant à la fois comme grevée de « contradictions internes » et comme la « philosophie morale par excellence ». L’article prend pour fil directeur le reproche (...) majeur qu’adresse Adorno à Kant d’avoir essayé de résoudre l’antinomie de la liberté et de négliger la dialectique de la liberté et de la non-liberté. Après avoir dégagé les déplacements sémantiques opérés par Adorno, il montre comment c’est en se situant par rapport à Kant qu’Adorno renouvelle la réflexion morale. (shrink)

This article discusses some of the theses put forward by Catherine Colliot-Thélène in her latest book, Le commun de la liberté (2022). After a brief reminder of the links of continuity between the latter and La démocratie sans “demos” (2011), concerning in particular the central question, in both books, of subjective rights, I turn to the author’s treatment of the themes of property and exclusion. With regard to property, whose meaning I seek to determine in the book, it is the (...) joint, paradoxical and ultimately fruitful use of Kant’s and Marx’s theories that is examined here. According to Colliot-Thélène, the major problem of contemporary democracies is exclusion due to the dispossession or absence of property, which defies their universalist principles: I underline the originality of her approach in terms of rights, and suggest some extensions that sociological and ethnological literature can provide to it. Dans cet article nous analysons des écrits réflexifs de fin de formation de mentors, afin d’identifier les marques de transformation de l’identité professionnelle et de l’agir professionnel. Nous proposons une analyse thématique et langagière des textes en tant que porteurs d’un rapport au monde professionnel en cours d’élaboration. Nous mettons en évidence que ces textes contiennent des traces de renormalisations issues des apprentissages conceptuels et formels autant que des apprentissages expérientiels réalisés durant la formation. En los años 1976 y 1977, la literatura parece tener una nueva función para Michel Foucault. Después de haberla considerado como un «pensamiento del fuera» en su análisis de Blanchot, que permitía huir del discurso, como línea de escape, Foucault, mientras afirma ya no interesarse por la literatura, sigue trabajando con ella de manera implícita y define otra manera de hacer con ella. Primero cambia la definición que le atribuía, con Roland Barthes: lo literario se hace «escritura» y alcanza lo (...) ético; por otra parte se presenta como una «forma de vivir», y en particular con el ejemplo de la escritura de sí mismo de Mauriac, que aparece como una práctica de subjetivación. Así, este artículo se propone estudiar esos años, para poner de relieve la inflexión que se trama en el pensamiento de Foucault a propósito de lo literario, al mismo tiempo que analiza las prácticas de sí de la Antigüedad. Nous proposons dans le cadre de cet article de penser à nouveaux frais la notion de témoignage à partir des travaux de Michel Foucault sur les pratiques de soi, en particulier dans les derniers cours au Collège de France. L’analyse du témoignage, dans ce cadre ne relève plus alors uniquement des études littéraires et remet en question la catégorie de « genre littéraire » affectée au témoignage. Il procède davantage d’un processus de subjectivation éthique qu’il s’agit d’appréhender à la lisière (...) de la philosophie et de la littérature. À partir d’un corpus de témoignages rendant compte de l’expérience concentrationnaire, il s’agira de mettre en évidence comment les derniers travaux de Michel Foucault fournissent des éléments pour penser cette notion transversale et déplacent le cadre épistémologique sur un terrain éthopoiétique. On a souvent réduit la théorie politique des stoïciens à leur éthique, accréditant ainsi le préjugé de l’apolitisme individualiste propre aux philosophies hellénistiques. The opposition between “in real life” an “in virtual life” is often used of, in order to distinguish between two parts of the world. We are supposed to live a virtual life on the Internet, behind the lightened screen of our computer, while we are supposed to live a real life in the real world. I claim that the Internet is not a virtual world, and that it is a part of the actual world for there are causal links between (...) the Internet and the so-called real world. According to David Lewis, worlds that are causally linked to each other cannot be different worlds. The only way to conceive of the Internet as a part of the actual world is to adopt Maurizio Ferraris’ hypothesis about documentality because, under such a hypothesis, what one writes has a causal power.
